These Terms of Use (“Terms”) govern your access to and use of the DealsInHorizon website and the property-screening reports and related services (the “Service”), operated by Kodiak Agancy LLC, a Wyoming limited liability company doing business as “DealsInHorizon” (“we,” “us,” or “our”), located in Houston, Texas. By accessing the website, requesting, or purchasing a report, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is
DealsInHorizon provides informational, automated, AI-assisted property-screening reports (“Reports”) compiled from public records, including Harris County, the Harris Central Appraisal District (HCAD), FEMA, and other public sources. Reports are produced and analyzed by automated means we refer to as “Horizon Analysis.”
2. Not professional advice; no relationship
The Service and the Reports are provided for general informational and screening purposes only. They are not legal, tax, title, survey, appraisal, insurance, or financial or investment advice; are not an appraisal or opinion of value; and do not constitute the practice of law, real estate brokerage, or any licensed activity. We are not a real estate broker, appraiser, attorney, title company, or financial advisor, and no fiduciary, agency, or advisory relationship is created. You should obtain independent professional advice before making any decision.
3. No warranty; “AS IS”
Reports are compiled from third-party and public-record sources that we do not control and have not independently verified. Public records change, may be incomplete, delayed, or contain errors. The Service and all Reports are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including any warranty of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that any Report is accurate, current, or complete.
4. Independent verification required
You are solely responsible for independently verifying all information before acting on it, including conducting your own title and lien search, confirming FEMA flood designation, and consulting qualified professionals. You assume all risk for any decision made in reliance on a Report.
5. Limitation of liability
To the maximum extent permitted by law, in no event will Kodiak Agancy LLC, its members, employees, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost opportunities, or losses arising from your use of or reliance on the Service or any Report. Our total aggregate liability for any claim arising out of or relating to the Service or a Report will not exceed the amount you actually paid for the specific Report giving rise to the claim. Some jurisdictions do not allow certain limitations; in that case, the limitations apply to the fullest extent permitted.
6. No third-party reliance
Each Report is prepared solely for the individual client who requested it. Reports may not be redistributed, resold, or relied upon by any third party. We have no liability to any person other than the requesting client.
7. Indemnification
You agree to indemnify and hold harmless Kodiak Agancy LLC and its members, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your reliance on any Report, your violation of these Terms, or your violation of any law or third-party right.
8. Acceptable use
You agree not to misuse the Service, including by reverse engineering, scraping, reselling, redistributing Reports, using the Service for any unlawful purpose, or using Report data to make decisions about individuals in a manner regulated by the Fair Credit Reporting Act (FCRA). Reports are about properties, not consumer reports about individuals, and may not be used for credit, employment, tenancy, or insurance eligibility decisions about any person.
9. Intellectual property
The Service, the Reports, the DealsInHorizon name and branding, and all related content are owned by Kodiak Agancy LLC and protected by law. Upon payment, you receive a limited, non-exclusive, non-transferable license to use a Report for your own internal business purposes only.
10. Payment
Paid Reports are governed by our Subscription, Billing & Refund Terms, which are incorporated into these Terms. Payments are processed by our third-party processor (Stripe); we do not store full payment-card details.
11. Termination
We may suspend or terminate access to the Service at any time for any reason, including violation of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Harris County, Texas, and you consent to that jurisdiction. You agree to first attempt to resolve any dispute informally by contacting us.
13. Changes
We may update these Terms at any time. Continued use of the Service after changes take effect constitutes acceptance.
